This paper analyzes the number of procedural and substantive tension points with which a conscientious whistleblower struggles. Included in the former are such questions as: (1) Am I properly depicting the seriousness of the problem? (2) Have I secured the information properly, analyzed it appropriately, and presented it fairly? (3) Are my motives appropriate? (4) Have I tried fully enough to have the problem corrected within the organization? (5) Should I blow the whistle while still a member of the organization (...) or after having left it? (6) Should I keep anonymity? (7) How ethical is it to assume the role of a judge? (8) How ethical is it to set in motion an act which will likely be very costly to many people? Substantive tension points include such questions as: (1) How fully am I living up to my moral obligations to my organization and my colleagues? (2) Am I appropriately upholding the ethical standards of my profession? (3) How adversely will my action affect my family and other primary groups? (4) Am I being true to myself? (5) How will my action affect the health of such basic values as freedom of expression, independent judgment, courage, fairness, cooperativeness, and loyalty? (shrink)

It is usual to classify the moral thinking of St. Thomas Aquinas as a theory of natural law. The purpose of the present article is to challenge such a classification. While the notion of natural law does play a part in Aquinas’s teaching on morality, this does not seem to me to be a central role. Indeed there are many reasons why it might be better, today, to stop talking about natural moral law, both in the context of Thomistic philosophy (...) and in the broader context of contemporary ethics. This work draws an analogical defence of strong emotionism—the metaethical claim that moral properties and concepts consist in the propensity of actions to elicit emotional responses from divergent emotional perspectives. I offer a theory that is in line with that of Prinz. I build an analogy between moral properties and what I call emotion-dispositional properties. These properties are picked out by predicates such as ‘annoying’, ‘frightening’ or ‘deplorable’ and appear to be uncontroversial and frequent cases of attribution error—the attributing of (...) subjective emotional states as mind-independent properties. I present a linguistic analysis supporting the claim that moral properties and their related concepts are reducible to a subset of emotion-dispositional properties and concepts. This is grounded in the observation that utterances featuring moral predicates function linguistically and conceptually in analogous ways to emotion-dispositional predicates. It follows from this view that asserted moral utterances are truth-apt relative to ethical communities, but that speakers misconceive the extensions of predicates. I show how the framework of Cognitive Linguistics allows us to explain this error. Further analysis of moral and non-moral utterances exposes the deeper conceptual schemas structuring language through cognitive construal processes. An understanding of these processes, coupled with an emotionist elucidation of moral properties and concepts, makes the attribution error an expected upshot of the emotionist thesis, rather than an uncomfortable consequence. Open-uterine surgery to repair spina bifida, or ‘fetal surgery of open neural tube defects,’ has generated questions throughout its history—and continues to do so in a variety of contexts. As clinical ethics consultants who worked (Mark J. Bliton) and trained (Virginia L. Bartlett) at Vanderbilt University—where the first successful cases of open-uterine repair of spina bifida were carried out—we lived with these questions for nearly two decades. We worked with clinicians as they were developing and offering the procedure, with (...) researchers in refining and studying the procedure, and with pregnant women and their partners as they considered whether to undergo the procedure. From this experience in the early studies at Vanderbilt, we learned that pregnant women and their partners approach the clinical uncertainty of such a risky procedure with a curious and unique combination of practicality, self-reflection, fear, and overwhelming hope. These early experiences were a major contributing factor to the inclusion of an ethics-focused interview in the informed consent process for the Management of Myelomeningocele Study (MOMS) trial study design. Currently, there is no consensus guideline as to the type or degree of donor steatosis considered acceptable for liver transplantation, and little is known about local practices in this area. The aim of this survey (...) was to evaluate current clinical practices amongst liver transplant surgeons in Australia and New Zealand in the evaluation and use of steatotic donor livers in LT.Methods: An anonymous online twelve-question survey was emailed to all practicing LT surgeons in ANZ in January 2010.Results: The response rate was 83%. Estimated prevalence of steatosis in donor livers was between 40% and 60%. In determining suitability for LT, 90% of respondents reported rejecting organs with "severe" steatosis based on visual and palpation grounds alone. A total of 68% sought further histological assessment if the donor liver looked bad and there were risk factors for steatosis. The majority of respondents performed only one biopsy of the liver, using hematoxylin and eosin staining for fat assessment. There was wide variation in the upper limit of steatosis considered to be acceptable for LT. A total of 21% of respondents still considered microvesicular steatosis a risk factor for primary graft nonfunction.Conclusion: This survey highlights the significant variation in the appraisal and use of steatotic grafts by LT surgeons in ANZ. Accurate evaluation and judicious use of mild and moderately steatotic grafts is required if we are to utilize the available donor pool best.Keywords: liver transplantation, steatosis, fatty liver, organ donors. I outline a theory of moral motivation which is compatible with the metaphysical claims of strong emotionism—a sentimentalist account of morality first outlined by Jesse Prinz and supported by myself which construes moral concepts and properties as a subset of emotion-dispositional properties. Given these claims, it follows that sincere moral judgements are necessarily motivating in virtue of their emotional constitution. I defend an indefeasible version of judgement motivational internalism which takes into consideration both positively and negatively valenced affective states and (...) how they promote both approach and avoidance motivation, respectively. On this view, in making sincere moral judgements agents are antecedently motivated by standing Desires to avoid or approach the stimuli picked out by their judgements. I also defend internalism against the objections from defeating circumstances and amoralists. As regards the former, I claim that the tendency of philosophers to frame the motivation debate in terms of positive moral judgements makes the argument from defeating circumstances appear more plausible than it is; as regards the latter, I claim the amoralist argument only has force if it is empirically well supported and that psychological data has hitherto been unconvincing. Despite increased attention to the question of how best to evaluate clinical ethics consultations and emphasis on external evaluation, there has been little sustained focus on how we, as clinicians, make sense of and learn from our own experiences in the midst of any one consultation. Questions of how we evaluate the request for, unfolding of, and conclusion of any specific ethics consultation are often overlooked, along with the underlying question of whether it is possible to give an accurate account (...) of clinical ethics consultants’ experience as experienced by ethics consultants. Before the challenge of submitting one’s accounts or case reports for review and evaluation from others, there is an underlying challenge of understanding and evaluating our own accounts. To highlight this crucial and deeply challenging dimension of actual clinical ethics practice, we present an account of a complex consultation, explicitly constructed to engage the reader in the unfolding experience of the consultant by emphasizing the multiple perspectives unfolding within the consultant’s experience. Written in script format, the three perspectives presented—prototypical clinically descriptive account; didactically reflective and self-evidentiary account often seen in journal presentations; highly self-critical reflective account emphasizing uncertainties inherent to clinical ethics practice—reflect different manners for responding to the ways actual clinical involvement in ethics consultation practice accentuates and refocuses the question of how to understand and evaluate our own work, as well as that of our colleagues.
